The labour inspection officer referred to in Article L. 8112-1 may request that an accredited body verify the conformity of second-hand work equipment and means of protection subject to the conformity certification procedure provided for in Article R. 4313-14 and which are the subject of one of the operations referred to in Article L. 4311-3, with the technical provisions applicable to them.
The employer or the person responsible for the operation referred to in Article L. 4311-3 shall provide proof that he has referred the matter to the accredited body within the time limit set and shall forward the results of the checks on the conformity of the work equipment to the Labour Inspectorate as soon as they are received.
A copy of the accredited body’s report is simultaneously sent by the employer to the prevention department of the relevant social security body.
The labour inspector may ask the employer to have a technical inspection of the occupational exposure limit values carried out by a body accredited in accordance with articles R. 4724-8 to R. 4724-13. He shall set the time limit within which the accredited body must be contacted.
The employer must prove that he has referred the matter to the accredited body within the time limit set and must forward the results to the Labour Inspectorate monitoring officer as soon as he receives them.
The Labour Inspectorate inspection officer may ask the employer carrying out an activity covered by Section 3 of Chapter II of Title I of Book IV, relating to the prevention of risks of exposure to asbestos, to have the levels of asbestos fibre dusting checked by an accredited laboratory, which will take the samples and carry out the analysis. The request for verification sets a deadline for completion.
The employer must prove that he has referred the matter to the accredited laboratory within the time limit set. It shall forward the results to the Labour Inspectorate as soon as they are received.
The labour inspector may ask the employer to have noise exposure measured by a body accredited in this field, in order to ensure compliance with the obligations relating to the prevention of the risks of exposure to noise provided for in Title III of Book IV.
The employer must prove that he has referred the matter to the accredited body within fifteen days of the date of the formal notice. It shall forward the results to the Labour Inspectorate within ten days of receiving them.
The labour inspector may ask the employer to have exposure to mechanical vibration measured by an accredited body, in order to ensure compliance with the obligations relating to the prevention of the risks of exposure to mechanical vibration set out in Title IV of Book IV.
