When a foreign national with evidence of at least eighteen months’ residence in another Member State under cover of an “EU Blue Card” issued by that State applies in France for a multi-annual residence permit bearing the words “passport talent-carte bleue européenne”, the decision on admission to residence in France is communicated to the competent authority of the Member State concerned.
When the multi-annual residence permit bearing the words “talent passport-European Blue Card” provided for in article L. 421-11 is issued on proof of a stay of at least eighteen months in another Member State under cover of an EU Blue Card issued by that State, it is issued no later than six months after the application is submitted.
As an exception to article R. 432-2, silence kept by the administrative authority on the application for a multi-annual residence permit bearing the mention “talent passport-European blue card” provided for in article L. 421-11 gives rise to an implicit decision of rejection after a period of ninety days.
An application for the issue of a residence permit bearing the wording “long-term resident-EU” provided for in articles L. 421-12 or L. 421-25 is equivalent to an application for renewal of the residence permit previously acquired.
Where the foreign national already has a residence permit bearing the words “long-term resident-EU” issued by another Member State of the European Union, mentioning that international protection has been granted, the residence permit bearing the words “long-term resident-EU”, issued by France on the basis of articles L. 421-12 or L. 421-25, bears the following statement under the heading “Remarks”: “The [name of the Member State] granted international protection on [date]”,…
The administrative authority’s decision on the application for a multiannual residence permit bearing the wording “talent-researcher passport” or “talent-researcher passport-mobility programme” provided for in article L. 421-14 is notified to the foreign national in writing as soon as possible and no later than sixty days from the date on which the complete application is submitted.
The list and approval procedures for organisations issuing the hosting agreement referred to in article L. 421-14 and the standard model of this agreement are established by joint order of the ministers responsible for immigration and for higher education and research.
