Title II: CATEGORIES OF RESIDENCE PERMITS

The Prefect shall issue the multiannual residence permit provided for in Articles L. 424-9 or L. 424-11 within three months of the decision granting subsidiary protection by the French Office for the Protection of Refugees and Stateless Persons or the National Court of Asylum. This time limit does not apply to the family members referred to in article L. 561-2.

The resident card bearing the wording “long-term resident-EU”, provided for in article L. 424-14, issued to a foreign national who benefits from subsidiary protection, bears the following wording under the heading “Remarks”: “France granted international protection on [date]”.

When another Member State asks France whether a foreign national who already holds a residence permit bearing the words “long-term resident-EU” provided for in article L. 424-14 remains under the protection of the French Office for the Protection of Refugees and Stateless Persons, the reply is sent by the prefect who issued the permit, within a maximum of one month following receipt of the application.

The application for the issue of a residence permit bearing the wording “long-term resident-EU” provided for in article L. 424-14 is equivalent to an application to renew the residence permit previously acquired.

If the benefit of subsidiary protection is terminated, under the conditions laid down in article L. 424-15, by a final decision of the French Office for the Protection of Refugees and Stateless Persons or by a court decision, or if the foreign national renounces this status, the residence permit may be withdrawn.When the permit is withdrawn pursuant to the first paragraph, the Prefect of the département in which the foreign…

A foreign national holding a residence permit bearing the words “long-term resident-EU” provided for in article L. 424-14, issued by France, may have it withdrawn if he loses the benefit of subsidiary protection in the cases mentioned in article L. 424-17.
