Lactariums carry out their activities of collecting, qualifying, processing, preserving, distributing and issuing breast milk on medical prescription, in compliance with the rules of good practice mentioned in the second paragraph of article L. 2323-1.
The rates for the sale and reimbursement of breast milk collected and processed in lactariums are set by order of the ministers responsible for health and social security.
The collection of breast milk includes: 1° Informing the prospective donor in advance of the conditions required for donating milk; 2° Interviewing the prospective donor in advance with a doctor, midwife or nurse; 3° Informing the donor of the hygienic and aseptic conditions under which the milk is collected and stored; 4° Checking the storage conditions of the milk before collection; 5° The collection of breast milk.
Candidates for anonymous donations and personalised donations of breast milk are subject to compulsory blood screening tests for transmissible diseases. These screening tests and the conditions under which they are carried out are set by order of the Minister for Health.
The lactarium is required to ensure: 1° The preparation of milk packaging; 2° The biological qualification and bacteriological analyses of donated milk; 3° The treatment of breast milk by pasteurisation; 4° The labelling of milk containers; 5° Preservation of milk after freezing or freeze-drying.
Biological tests are carried out either by the authorisation holder or by a medical biology laboratory with which it has an agreement.
The lactarium can transport breast milk.
The purpose of nurseries is to provide day and night care for children under the age of three who cannot remain with their families or benefit from supervised foster care. Nurseries are divided into two categories: 1° Social nurseries, which receive children whose state of health does not require special medical care and which come under article L. 312-1 of the Code de l’Action Sociale et des Familles ; 2°…
Social nurseries and health nurseries may be grouped together in the same establishment, provided that the establishment has two separate departments.
