The Court of First Instance shall rule within ten days of the date of the appeal, without formality and without costs, and on simple notice given five days in advance to the parties concerned.
The decision of the judicial tribunal is notified without delay and within three days at the latest by the court registry to the applicant and the interested parties by registered letter with acknowledgement of receipt. The Autorité des relations sociales des plateformes d’emploi forwards it to the service provider mentioned in the order of the Minister for Employment provided for in Article R. 7343-3.
The appeal is lodged, investigated and judged under the conditions laid down by the Code of Civil Procedure for professional elections. The parties are exempted from the requirement to appear before the Conseil d’Etat and the Cour de Cassation.
The time limits set by articles R. 7343-16 and R. 7343-18 to R. 7343-20 are calculated and extended in accordance with the provisions of articles 640 to 642 of the Code of Civil Procedure.
Applications from the organisations referred to in Article L. 7343-2 shall be submitted electronically. An organisation that applies in two sectors of activity submits two separate applications. An order by the Minister for Labour sets the procedures and period for the submission of applications by candidate organisations, as well as the model documents required for the submission of applications.
Any declaration of candidacy by an organisation must be accompanied by the following documents: 1° A declaration on honour by the representative of this organisation certifying that his candidacy meets the requirements laid down in article L. 7343-6 and specifying the sector(s) of activity in which the organisation is standing as a candidate; 2° A copy of its articles of association; 3° A copy of the receipt for filing its…
The Autorité des relations sociales des plateformes d’emploi, which is responsible for examining the declaration of candidacy, will issue an electronic receipt to the representative of the candidate organisation as soon as the declaration complies with the deadline set by the order referred to in Article R. 7343-23. The Director General of the Autorité des relations sociales des plateformes d’emploi shall publish the list of admissible applications on the website provided for in Article R. 7343-10 fifteen days after expiry of the application period referred to in Article R. 7343-23.
Decisions relating to the validation of one or more candidacies may be contested, on pain of inadmissibility, by application to the judicial court within seven days of the publication referred to in article R. 7343-26. It may be lodged by any elector or any representative of a candidate organisation under the conditions laid down in articles 54 and 57 of the Code of Civil Procedure.
