Book II: Provisions applicable to certain categories of workers

Recognition of the seriousness of the disability referred to in Article L. 5212-9 and the allocation of the aid referred to in Article L. 5213-11 are decided by the association referred to in Article L. 5214-1.

The purpose of adjusting the annual contribution and allocating the employment aid provided for in articles L. 5212-9 and L. 5213-11 is to compensate for the severe disability of a person covered by the employment obligation. The severity of the disability is assessed, with regard to the workstation, after optimal adaptation of the latter.

The request for recognition of the seriousness of the disability is submitted by the employer using a form, the model for which is set by joint order of the ministers responsible for employment and the disabled.
