Chapter VII: Provisions specific to certain institutions and organisations

The Board of Directors of the Fresnes National Public Health Establishment, which is intended exclusively for prisoners, comprises : 1° As chairman, a Conseiller d’Etat or a senior judge of the Cour de Cassation, appointed by the Minister of Justice; 2° A member of the National Assembly ; 3° A member of the Senate; 4° The mayor of Fresnes or his representative, appointed from among its members by the municipal…

The term of office of the Chairman of the Board of Directors and the members mentioned in 5°, 6°, 10°, 11° and 12° of article R. 6147-14 is set at three years. The term of office of the other members of the Board of Directors ends at the same time as the term of office or functions in respect of which the persons concerned were elected or appointed.

Articles R. 6141-10 to R. 6141-12, R. 6143-15, R. 6143-23, R. 6143-24 and R. 6144-42 do not apply to the National Public Health Establishment in Fresnes. The powers attributed to the Director General of the Regional Health Agency by articles R. 6143-16 and R. 6143-20 are exercised by the Minister of Justice and the Minister of Health with regard to the members of the institution’s Board of Directors.

The Director of Prison Administration, the Director of General Administration and Equipment at the Ministry of Justice, the Director General of Healthcare and the Director General of Health may attend or be represented at meetings of the Board of Directors in an advisory capacity.

By way of derogation from article L. 6144-4, the Technical Committee of the establishment comprises, on the one hand, the Chairman of the Board of Directors, the Director of the Prison Administration or his representative, the Director General of Healthcare or his representative, the Director of the establishment and, on the other hand, four representatives of the establishment’s staff covered by Title IV of the General Statute for Civil Servants….

The members representing the staff are appointed for a period of three years, from among the permanent staff, by the most representative trade union organisations in proportion to the average number of votes received by each of these organisations on the occasion of the renewal of the local joint committees, with the remaining votes being distributed on the basis of the highest average. The Director shall determine the composition of the Committee.

The Committee is chaired by the Chairman of the institution’s Board of Directors. It elects a Vice-Chairman from among its members.

If, before the expiry of his term of office, one of the full members is no longer able, for whatever reason, to carry out his duties, his alternate is appointed in his place until the renewal of the establishment’s Technical Committee.
