Chapter VII: Provisions specific to certain institutions and organisations

The Committee shall be convened by its Chairman; it shall be convened at the written request of the Director or of at least one third of the full members. In the latter case, the meeting must be convened within a maximum of eight days. In any event, the Committee shall meet at least twice a year.

The secretariat of the Committee is provided by the Director of the establishment. Minutes are taken after each meeting.

Committee meetings are not open to the public. The Committee may decide to hear any competent person on the issues on the agenda.

The committee issues opinions or wishes by a majority of the members present. In the event of a tie, the Chairman has the casting vote.

The Chairman immediately informs the Board of the opinions and recommendations of the Committee.

The committee is informed of the action taken on its opinions and recommendations.

Committee members are bound by the obligation of professional discretion with regard to all facts and documents of which they have knowledge in this capacity.

Special leave entitlements which do not count towards annual leave entitlements are granted, under the conditions set out in Article 45 of Title IV of the General Statute for Civil Servants, to paid employees of the establishment who are members of the Committee, to enable them to carry out their duties.

The provisions of article R. 6145-54 are applicable to the establishment on a date set by order of the ministers responsible for the budget and health.

The Etablissement public de santé de Fresnes is subject to the provisions of titles I and III of decree no. 2012-1246 of 7 November 2012 relating to public budgetary and accounting management, with the exception of 1° and 2° of article 175, articles 178 to 185, 204 to 208 and 220 to 228.
