Title X: Legal costs

Witnesses may be granted, if they so request: . 1. An appearance allowance; 2. Travel expenses; 3. A daily subsistence allowance;

Compensation awarded to witnesses shall be paid by the Treasury only insofar as they have been summoned or called, either at the request of the public prosecutor or pursuant to an order made ex officio in the cases provided for in articles 283 and 310.

Witnesses summoned or called at the request of either the accused or the civil parties shall receive the above-mentioned indemnities. They are paid to them by those who called them as witnesses.

Military personnel of the land, sea and air and space armies, on active service, when called as witnesses, are not entitled to any tax or indemnity payable out of the criminal, correctional and police justice funds, for travel and subsistence expenses, unless they are summoned to the place of their domicile, while on leave or on furlough, and on the date of their appearance such leave or furlough, is still…

Magistrates are required to state, in the warrants they issue for the benefit of witnesses, that the allocation of the compensation provided for in article R. 123 has been requested.
