For the application of III of article L. 442-4, the seat and jurisdiction of the judicial courts with jurisdiction in mainland France and the overseas departments are set in accordance with the table in appendix 4-2-2 of this book. The Court of Appeal with jurisdiction to hear decisions handed down by these courts is that of Paris.
Infringements of the provisions of articles L. 442-10 and L. 442-11 are punishable by the fine laid down for fifth-class contraventions. Repeated offences are punishable in accordance with the provisions of articles 132-11 and 132-15 of the Criminal Code.
The agricultural products to which the provisions of I of Article L. 443-2 apply are as follows: Fruit and vegetables, with the exception of ware potatoes, intended to be sold fresh to the consumer; Fresh, frozen or deep-frozen poultry and rabbit meat; Eggs; Eggs Eggs; Honeys.
The minimum order cancellation period provided for in the first paragraph of article L. 443-5 applicable to wholesalers mentioned in II of article L. 441-4 is set at twenty-four hours.
Subject to the provisions of article D. 443-3, the minimum order cancellation period provided for in the first paragraph of article L. 443-5 is set at three days for fresh fruit and vegetables, unless they are intended to be sold under a private label within the meaning of article R. 412-47 of the Consumer Code, in which case this minimum period is set at six days.
This section applies to the tariffs mentioned in the first paragraph of Article L. 444-1.
