The departmental councils may, by concurring deliberations, decide either the withdrawal of a department from the interdepartmental institution or the dissolution of the latter. The deliberations set out the conditions for withdrawal or dissolution.
The interdepartmental institution may be dissolved, of its own accord or at the request of one or more of the associated departments, when the institution proves impossible to operate. Dissolution is pronounced by decree issued after the assent of the Conseil d’Etat. This decree sets out the conditions for dissolution.
Two or more regions may, by concordant deliberations of their regional councils, enter into agreements with each other. The deliberations must include an undertaking to enter in the budget of each region concerned the expenditure necessary to achieve the jointly agreed purpose. Each regional council shall take programme deliberations for this purpose, as necessary. .
If the agreement relates to powers exercised by the regions, pursuant to article L. 4211-1, the acceptance of the legal entities on whose behalf each region acts is required. The acceptance of local authorities and public establishments is given in accordance with the legislative and regulatory provisions governing them. Acceptance by the State is the subject of agreements prepared and concluded by the territorially competent regional prefects.
The presidents of the regional councils concerned sign the agreement between the regions, in the light of the concordant deliberations of the regional councils and, where applicable, the acceptances given under the conditions provided for in Article R. 5611-2. The provisions of article R. 4313-5 are applicable to the establishments mentioned in article L. 5622-4.
