Book II: Combating illegal employment

On receipt of the declaration referred to in Articles R. 8293-1 to R. 8293-3, the union of funds referred to in Article R. 8291-2 sends the professional identification card to the employer or the employer’s representative, or to the user company of a seconded temporary employee.

The holder of the professional identification card must inform his employer or the user company within twenty-four hours of any damage, loss or theft of his card, so that the employer or the user company can inform the union of funds mentioned in article R. 8291-2, in accordance with the procedure laid down by this body. On termination of their contract with the company or at the end of their secondment in France, employees are required to return their professional identification card to their employer or to the user company so that the latter can forward it to the union of funds mentioned in article R. 8291-2, for destruction.

The holder of the professional identification card or provisional certificate must produce it without delay at the request of any of the control officers referred to in article L. 8271-1-2.

Any client or instructing party may check with the union of funds mentioned in article R. 8291-2 that the employees of its co-contractor, of a direct or indirect sub-contractor or of a sub-contractor’s co-contractor have been declared to this body and that their cards or certificates have been issued by it. This verification is carried out using the code provided for in 3° of article R. 8292-1.

Any employee holding a professional identification card or provisional certificate must produce it without delay at the request of the project owner or a principal working on the site where the employee is employed.
