Title II: Water and food safety

The installations intended for the exploitation of natural mineral water are designed, constructed and maintained in such a way as to avoid any possibility of contamination or modification of the essential characteristics of the water as it emerges. They include suitable devices for monitoring the quantity and quality of the water, on a permanent and recorded basis. Operating conditions must meet hygiene requirements and must not be harmful to health.

The operator shall ensure that all stages of the production and distribution of natural mineral water under his responsibility comply with hygiene rules. The operator sends the Director General of the Regional Health Agency, who informs the Prefect as necessary, an annual summary report including, in particular, a table of analysis results and any information on the quality of the natural mineral water and on the operation of the operating system, in particular monitoring, works and malfunctions. The provisions of I of article R. 1321-49 are applicable to the operator of a natural mineral water. In addition, the operator must use materials in contact with the natural mineral water that are compatible with its composition so as to prevent any chemical, physico-chemical, microbiological or organoleptic alteration of the quality of the water as it emerges.

The treatments or additions to which natural mineral waters may be subjected are those appearing on a list determined by order of the Minister responsible for health and, in the case of packaged water, by order of the Ministers responsible for consumption and health, under the conditions set by 4° of II of article L. 1322-2. The products used for cleaning and disinfecting the facilities are composed of constituents that meet the conditions set out in article R. 1321-54. Specific conditions for the use of products and processes used in a spa establishment are laid down, where necessary, by order of the Minister for Health. The natural mineral water distribution network is specific and identified in relation to other water distribution networks. This article applies without prejudice to the provisions of article R. 1322-37-1 for packaging.
