Exceptional aid is granted in the form of direct allocations to distribution companies in order to compensate for part of the loss of revenue suffered as a result of the impact on attendance at cinemas of the introduction of the health pass, as provided for by decree no. 2021-699 of 1 June 2021 prescribing the general measures required to manage the end of the health crisis.
Direct allocations are awarded to distribution companies that meet the conditions of article 221-4 for the distribution of cinematographic works that:1° Were released in cinemas between 14 July 2021 and 28 September 2021;2° Have not given rise to the issue of a distribution licence mentioned in article 222-3.
The amount of the direct allocation is set by applying the following flat-rate amounts to admissions made between 14 July 2021 and 28 September 2021: – 0.75 € per entry for the fraction of entries less than or equal to 50,000;– 0.45 € per entry for the fraction of entries greater than 50,000 and less than or equal to 100,000;– 0.20 € per entry for the fraction of entries greater…
Distribution companies shall take all necessary steps to ensure that the sum corresponding to the total amount of aid they have received under this sub-section is treated in accordance with the same contractual terms as those laid down for cinema box office receipts.
To obtain the aid, distribution companies must submit a form drawn up by the Centre national du cinéma et de l’image animée electronically by 31 January 2022 at the latest.
The decision of the President of the Centre national du cinéma et de l’image animée specifies the amount of aid awarded and the terms of payment.
The granting of exceptional aid is subject to the provisions of Commission Regulation (EU) No 651/2014 of 17 June 2014 declaring certain categories of aid compatible with the internal market in application of Articles 107 and 108 of the Treaty, in particular those provided for in Chapter I and Article 54 of Section 11 relating to aid schemes for audiovisual works.
In order to take account of the difficulties of investment linked to the deteriorated conditions in which cinematographic works are shown in cinemas and to encourage the distribution of new works, sums are exceptionally entered into the automatic account of distribution companies.
For each distribution company, the amount of the sums entered on an exceptional basis is equivalent to the amount of the sums entered on its automatic account which lapsed on 31 December 2021 pursuant to 2° of article 123-8, excluding those which benefited from the extension provided for in article 916-12.
