For each cinema, the amount of the direct allocation is determined by applying the percentage corresponding to the market share of this cinema to the amount of credits allocated to direct allocations.The amount of the direct allocation may not exceed 70% of the mathematical opposite of the gross operating surplus at fixed costs mentioned in article 2 of the aforementioned decree no. 2021-310 of 24 March 2021.
To obtain the aid, cinema operators must submit the form drawn up by the Centre national du cinéma et de l’image animée electronically by 31 October 2021 at the latest.
The decision of the President of the Centre national du cinéma et de l’image animée specifies the amount of aid awarded and the terms of payment.
The granting of the exceptional aid is subject to the provisions of exempted framework scheme No SA.42681, relating to aid for culture and heritage conservation for the period 2014-2023, adopted on the basis of Commission Regulation No 651/2014 of 17 June 2014 declaring certain categories of aid compatible with the internal market in application of Articles 107 and 108 of the Treaty.
New exceptional aid is being granted in the form of a direct allowance to cinema owners to help compensate for the drop in business they have been experiencing since March 2020 as a result of the measures restricting and banning admission to cinemas.
This aid is granted under the same terms and conditions as those provided for in articles 916-26 to 916-33.However, the 20% reduction provided for in the ninth paragraph of article 916-28 and the deadline provided for in article 916-31 do not apply.
In order to obtain the aid, cinema operators must complete and submit electronically, by 30 April 2022 at the latest, a form drawn up by the Centre national du cinéma et de l’image animée.
The amount of aid may not exceed that of the actual loss of turnover recorded over the period between 1 January and 30 June 2021 compared with the average turnover achieved between 1 January and 30 June in 2017, 2018 and 2019, less the aid allocated in application of articles 916-25 to 916-33 as well as the amounts of the subsidies intended to compensate for the loss of turnover suffered…
A direct allocation is granted in addition to the new cross-cutting aid to compensate for the drop in activity granted in application of sub-section 4, in order to take into account the consequences on attendance at cinematographic entertainment establishments of the implementation of the health pass, provided for by decree no. 2021-699 of 1st June 2021 prescribing the general measures necessary for managing the end of the health crisis.
