Title II: Organisation of the medical professions

The provisions of articles L. 2141-1 to L. 2141-14 of the French Public Procurement Code, relating to the grounds for exclusion from the award procedure, are applicable to contracts awarded by the National Council.

If the National Council uses the tender procedure, it cannot negotiate with the tenderers. It may only ask them to specify the content of their tender. Where the national council uses the procedure with negotiation, it may award the contract on the basis of the initial tenders without negotiation, provided that it has indicated in the contract notice that it reserves the right to do so.

The National Council verifies the information contained in the application, including that concerning the economic operators on whose capabilities the candidate relies. The National Council may, at any time, declare a procedure to be discontinued. When it declares a procedure to be discontinued, the National Council shall as soon as possible communicate the reasons for its decision not to award the contract or to recommence the procedure to the economic operators who participated in it.

I.-The National Council immediately notifies each candidate or tenderer concerned of its decision to reject their application or tender.
