A decree of the Conseil d’Etat shall lay down the conditions for the application of this section, in particular the procedures for registration on the lists of sworn goods brokers, as well as those relating to the taking of the oath, honorary membership, disciplinary procedures and the organisation and operation of the National Council of Sworn Goods Brokers.
A commission agent is one who acts in his own name or under a corporate name on behalf of a principal. The duties and rights of a commission agent acting on behalf of a principal are determined by the Title XIII of Book III of the Civil Code.
The commission agent has a lien on the value of the goods which are the subject of his obligation and on the documents relating thereto for all his claims for commission against his principal, even if arising in connection with earlier transactions. The commission agent’s lien claim includes, together with the principal, interest, commission and incidental costs.
The commission agent who undertakes transport by land or water is obliged to enter in his logbook a declaration of the nature and quantity of the goods, and, if required, their value.
He is responsible for the arrival of the goods and effects within the period specified in the consignment note, except in cases of legally established force majeure.
He is liable for damage to or loss of goods and effects, unless otherwise stipulated in the consignment note, or force majeure. .
He is guarantor of the facts of the intermediate commission agent to whom he sends the goods.
Goods leaving the seller’s or the shipper’s warehouse travel, unless otherwise agreed, at the risk and peril of the person to whom they belong, subject to his recourse against the commission agent and the haulage contractor entrusted with the transport.
