The reception conditions, within the meaning of Directive 2013/33/EU of the European Parliament and of the Council of 26 June 2013 laying down standards for the reception of persons seeking international protection, from which asylum seekers benefit are laid down by the provisions of this Title.
The Office de l’immigration et de l’intégration may, by agreement, delegate to legal entities the possibility of providing certain reception, information and social, legal and administrative support services for asylum seekers during the period their application is being examined. .
In accordance with article L. 240-1, the provisions of this Title apply to non-EU foreign nationals whose situation is governed by Book II.
The national plan for the reception of asylum seekers and the integration of refugees sets the proportion of asylum seekers received in each region and the distribution of accommodation for them. It is drawn up by the Minister responsible for asylum, after consultation with the Ministers responsible for housing and social affairs. It is sent to Parliament.
A regional plan is drawn up in accordance with the national plan for the reception of asylum seekers.It lays down guidelines for the distribution of accommodation facilities for asylum seekers and refugees in the region, presents the planned regional arrangements for registering asylum applications and monitoring and supporting asylum seekers, and defines actions to promote the integration of refugees. The Office français de l’immigration et de l’intégration (French Office for Immigration and Integration) will determine the region of residence on the basis of the proportion of asylum seekers received in each region in application of the national plan and taking account of the applicant’s needs and personal and family situation in the light of the assessment provided for in Chapter II of Title II and the existence of structures…
When the proportion of asylum seekers residing in a region exceeds the proportion set for that region by the national reception plan for asylum seekers and the reception capacity of that region, the asylum seeker may be directed to another region, where they are required to reside while their asylum application is examined.
Unless there are compelling reasons or they have been summoned by an authority or court, applicants wishing to leave their region of residence temporarily must apply for authorisation from the French Office for Immigration and Integration, which will issue its decision as soon as possible, taking into account the applicant’s personal and family circumstances.
The conditions for the application of articles L. 551-3 to L. 551-5 are laid down by decree in the Conseil d’Etat.
Asylum seekers who do not have a stable place of residence elect domicile with a legal entity approved for this purpose for each département, under conditions laid down by decree in the Conseil d’Etat. .
