Book III: Vocational training

Failure to comply with article L. 6352-13 by means of advertising containing information that is likely to mislead as to the conditions of access to the courses on offer, their content, penalties or funding arrangements, is punishable by one year’s imprisonment and a fine of €4,500.

Failure by any training provider to conclude a contract with a natural person who undertakes training on an individual basis and at his own expense, in breach of the provisions of article L. 6353-3, is punishable by a fine of 4,500 euros.

Any training provider who draws up a contract that does not include the requirements set out in article L. 6353-4 is liable to a fine of 4,500 euros.

Any training provider who, before expiry of the withdrawal period provided for in article L. 6353-5, requires the trainee to pay sums in breach of the provisions of the first paragraph of article L. 6353-6 is liable to a fine of 4,500 euros. Failure to comply with the provisions of article L. 6353-7 will result in a fine of 4,500 euros being imposed on any trainee who is unable to attend the training course due to duly recognised force majeure.

Any training provider who fails to provide the trainee with the document referred to in article L. 6353-8 prior to final enrolment and payment of fees is liable to a fine of 4,500 euros.

Conviction for the penalties provided for in articles L. 6355-1 to L. 6355-22 may be accompanied, as an additional penalty, by a temporary or permanent ban on exercising the activity of manager of a vocational training organisation.
