The Regional Council shall be notified of the details of the declaration of activity and any amendments thereto. It will be notified of the educational and financial report on the activity, the balance sheet, the profit and loss account and the notes to the accounts for the last financial year closed by the bodies whose training activities within the meaning of article L. 6313-1 benefit from its financial support.
The list of organisations declared under the conditions laid down in this chapter and up to date with their obligation to submit the educational and financial report referred to in article L. 6352-11 is made public and includes information relating to the organisation’s company name, its workforce, a description of the training courses provided and the number of employees and persons trained.
A decree in the Conseil d’Etat shall determine the terms and conditions for the application of this chapter.
The person referred to in Article L. 6351-1 must provide evidence of the qualifications and experience of the teaching and supervisory staff involved in any capacity whatsoever in the training services it provides, and of the relationship between these qualifications and the services provided in the field of vocational training.
No one may, even de facto, exercise a management, apprentice teaching or administrative function in a training organisation if they have been convicted of a criminal offence constituting a breach of probity, good character or honour.
All training organisations draw up internal rules applicable to trainees and apprentices. These rules are a written document setting out the main measures applicable in terms of health, safety in the establishment and discipline, as well as the procedures for representing trainees and apprentices.
A decree in the Conseil d’Etat shall determine the implementing measures for this section.
Each year, private-sector training providers draw up a balance sheet, profit and loss account and notes to the accounts in accordance with conditions laid down by decree.
Multi-activity training bodies keep separate accounts for their continuing vocational training and apprenticeship activities.
A Conseil d’Etat decree issued in accordance with articles L. 221-9, L. 223-35 and L. 612-1 of the French Commercial Code sets specific thresholds for training providers with regard to the obligation to appoint a statutory auditor.
