Without prejudice to the provisions of article R. 2223-91, health establishments may meet their obligation to have a mortuary room by using the options open to them in terms of hospital cooperation. .
As far as possible, the family shall have access to the deceased before the body is deposited in the mortuary without this deposit being delayed, as a result, by more than ten hours as provided for in the fifth paragraph of article R. 2223-76.
The director in the case of a public establishment or its qualified body in the case of a private establishment sets the prices for stays in mortuary rooms beyond the three-day period provided for in l’article R. 2223-89.

An order of the minister responsible for health determines the operating conditions of mortuary chambers.
Health establishments other than those mentioned in Article R. 2223-90, as well as establishments providing accommodation for the elderly mentioned in 6° of the Code de l’action sociale et des familles, may create and manage mortuary rooms under the conditions defined in articles R. 2223-91 to R. 2223-96.
Health establishments and the establishments mentioned in Article L. 312-1of the Code de l’action sociale et des familles may not be authorised to manage the funeral chambers mentioned in Article L. 2223-38. They may not authorise in any form whatsoever the installation of a burial chamber on their premises or on one of their plots.
The crematorium, as defined in Article L. 2223-40, must comply with the requirements laid down in articles D. 2223-100 to D. 2223-103.
Silence kept for more than six months on the request for the creation and extension of crematoria provided for by Article L. 2223-40 is deemed to be a decision to reject.
