Failure to comply with the provisions of article L. 3163-3, applicable to the employment of young workers aged between sixteen and eighteen for temporary work in cases of extreme urgency, is punishable by a fourth-class fine, imposed as many times as there are employees affected by the offence.
The employer may, under his sole responsibility and by informing the labour inspector, derogate from the minimum period of eleven hours’ daily rest per employee in the event of urgent work whose immediate execution is necessary in order to: 1° Organise rescue measures ; 2° Prevent imminent accidents; 3° Repair accidents to equipment, installations or buildings.
The derogations provided for in articles D. 3131-1 and D. 3131-4 to D. 3131-7 are subject to the allocation of at least equivalent periods of rest to the employees concerned. Where it is not possible to grant such rest, equivalent compensation is provided for by collective labour agreement.

In the event of an increase in activity, the agreement provided for in article L. 3131-2 may provide for a reduction in the daily rest period.
A collective labour agreement may not have the effect of reducing the daily rest period to less than nine hours.
In the event of increased activity, in the absence of a collective labour agreement, a reduction in the daily rest period may be implemented under the conditions defined in articles D. 3121-5 to D. 3121-7.
Establishments in the industries listed in the following table, which allocate the weekly rest period to all employees on the same day, benefit from the suspension of the weekly rest period provided for in Article L. 3132-5: Furniture, upholstery, trimmings for furniture.
