Book V: RIGHT OF ASYLUM AND OTHER INTERNATIONAL PROTECTION

Asylum seeker reception centres are governed by the provisions of this section and by the provisions of the Code de l’action sociale et des familles.

For the purposes of managing the accommodation facilities for asylum seekers referred to in Article L. 552-1 other than hotels, the Minister responsible for asylum shall set the following standard documents by order:1° The specifications for the accommodation facilities for asylum seekers;2° The accommodation contract signed between the manager of these accommodation facilities and the asylum seekers accommodated;3° The operating regulations for the accommodation facilities for asylum seekers.

The places of accommodation referred to in Article L. 552-1 receive correspondence intended for domiciled persons and make it available to them.

People accommodated in an accommodation facility for asylum seekers mentioned in article L. 552-1 whose monthly resources are equal to or greater than the amount of the active solidarity income defined in article L. 262-2 of the social action and family code pay a financial contribution towards their accommodation and maintenance costs, under conditions defined by order of the ministers for social affairs, asylum and the budget. The amount of the financial contribution received by the accommodation facility is deducted when calculating the overall funding allocation provided for in Article R. 314-150 of the Social Action and Family Code.

The manager of the place of accommodation shall, as soon as possible, report any unjustified and prolonged absence, any violent behaviour and any serious breach of the rules of the place of accommodation to the Office français de l’immigration et de l’intégration and to the prefect of the département in which the place of accommodation is located.

The place of accommodation keeps the files of the persons accommodated for two calendar years after their discharge. The files kept in this way may at any time be subject to an on-site inspection by the departmental prefect or, in Paris, the police prefect.
