Authorised agencies, companies or associations, in accordance with article L. 2223-23, who organise the funeral of a person whose body is to be cremated, under the conditions set out in article R. 2213-34, are required to inform the families of the provisions of articles L. 2223-18-1 and L. 2223-18-2.
Financing arrangements for funerals referred to in 2° of article L. 2223-20 and offered by the régies, companies, associations and their establishments authorised in accordance with Article L. 2223-23 are contracts whose performance depends on the duration of human life within the meaning of 1° of Article L. 310-1 of the Insurance Code.
Regies, companies, associations and their establishments applying for the authorisation provided for in Article L. 2223-23 must provide evidence that their directors and officers, appointed or confirmed in their posts, who perform one of the functions referred to in articles R. 2223-42 to R. 2223-47 have the professional capacity defined by the articles D. 2223-35 à D. 2223-39.
Agents who can justify or are deemed to justify professional training corresponding to one of the functions referred to in articles R. 2223-42 and R. 2223-44 have the professional capacity to exercise this function.
Agents who have the professional capacity under the conditions of Article D. 2223-35 are deemed to provide proof of professional training for the function they perform.
The thanatopractors who hold the national diploma provided for in Article L. 2223-45 have the professional capacity to perform conservation care. Only thanatopractors who can prove that they have undergone the vaccination mentioned in article L. 3111-4-1 of the Public Health Code or exemption from or contraindication to this vaccination as specified in article R. 3111-4-2 may carry out this conservation care.
Persons who carry out their duties without being in direct contact with families and without personally participating in the conclusion or performance of any of the funeral services listed in Article L. 2223-19 do not have to meet minimum professional competence requirements under this sub-paragraph.
