The representative of each of the geographical sub-sections on the central council of section E, referred to in article L. 4232-13, and his alternate, are elected by all the pharmacists in each of these districts.
Each Central Council elects the representatives of its section to the National Council on the date mentioned in article D. 4233-7, after having elected its executive committee.
Before the election takes place, the pairs of candidates and their alternates send or hand in their nomination papers and any circulars to the President of their Central Council, who forwards them to the members of the Central Council.
The election takes place at a meeting of the Central Council, by secret ballot. Elected full members and appointed members present and voting take part. In the first and second rounds, an absolute majority of the voting members of the Board is required. In the third ballot, a relative majority is sufficient.
Notwithstanding the provisions of articles D. 4233-24 to D. 4233-26, the tandem representing section E on the council is elected by post or electronically by all the full members of the overseas pharmacists’ delegations, in accordance with the procedures set out in this chapter. The president, vice-president, treasurer or a member in charge of a specific mission of a regional, central or national council or of a delegation may receive an allowance linked to these responsibilities. The elected members of a regional, central or national council or of a delegation of the Order, who are not entitled to the allowance provided for in article D. 4233-28, may receive an allowance for participation in the work of the Order when they sit or participate in an Ordinary meeting or carry out an ad hoc assignment at the request of the president of their council or delegation. The Council’s deliberations may be adopted by videoconference in accordance with the procedures defined by the Association’s internal regulations referred to in article L. 4231-7.
An attempt at conciliation is a compulsory prerequisite to referral to the Disciplinary Board of first instance, unless the complaint comes from one of the authorities mentioned in 1°, 2° or 3° of article R. 4234-1.
