If the request is not granted, an appeal may be lodged unless the order is issued by the First President of the Court of Appeal. The time limit for appeal is fifteen days. The appeal is lodged, investigated and judged as in non-contentious matters. If the application is granted, any interested party may refer the matter to the judge who made the order.
The judge has the option of amending or retracting his order, even if the case is before the judge hearing the case on the merits.
The provisions of this Title shall not apply to measures of judicial administration.
A judgment which is not subject to an appeal suspending enforcement has the force of res judicata. A judgment that is subject to such an appeal acquires the same force on expiry of the time limit for the appeal if the appeal has not been lodged within the time limit.
The judgment is enforceable, subject to the conditions that follow, from the moment it becomes res judicata unless the debtor benefits from a period of grace or the creditor from provisional enforcement.
No judgment or deed may be enforced except on presentation of a certified copy, unless otherwise provided by law.
Judgments may not be enforced against those against whom they are opposed until they have been notified, unless enforcement is voluntary. In the event of enforcement solely on the basis of the original document, presentation of the latter is equivalent to notification.
Proof of enforceability arises from the judgment where it is not subject to any suspensive appeal or is provisionally enforceable. In other cases, this proof results from: – either the acquiescence of the convicted party; – or from notification of the decision and a certificate making it possible to establish, by reconciliation with this notification, the absence, within the time limit, of an opposition, an appeal, or an appeal in…
Any party may obtain from the registrar of the court before which the appeal could have been lodged a certificate attesting to the absence of any opposition, appeal or appeal in cassation or indicating the date of the appeal if one has been lodged.
