Outdoor sports facilities with a capacity not exceeding 3,000 spectators and indoor sports facilities with a capacity not exceeding 500 spectators are not subject to approval.
Authorisation to open to the public may not be given before the expiry of a period set by regulation.
Withdrawal of approval means withdrawal of authorisation to open to the public.
A Conseil d’Etat decree sets out the conditions for the application of articles L. 312-5 to L. 312-9. It shall specify the conditions for issuing and withdrawing the approval provided for in article L. 312-5.
The design, construction and operation of ski lifts and the development of downhill ski runs are governed by articles L. 445-1 à L. 445-4 du code de l’urbanisme et les articles L. 342-7 à L. 342-26 du code du tourisme.
Authorisation to open to the public temporary facilities set up in a sports arena subject to the provisions of article L. 312-5 is granted by the mayor under the conditions laid down by the provisions of the Construction and Housing Code and by the approval order. A Conseil d’Etat decree sets out the conditions for application of article L. 312-12. This decree specifies the deadlines for the safety commission to give its opinion and for the mayor to take his decision.
Organising a public sporting event in a non-approved venue or in breach of the requirements imposed by the approval is punishable by two years’ imprisonment and a fine of 75,000 euros.
The penalties laid down in article L. 312-14 apply to the issuing or transfer, whether free of charge or for consideration, of admission tickets to a sporting event in excess of the number of spectators set by the approval order.
The penalties provided for in article L. 312-14 are doubled if the offender is also convicted of manslaughter or unintentional bodily harm.
