Where the acts are committed in a state of legal recidivism, the court may, by special reasoned decision, issue a committal or arrest warrant against the accused, regardless of the length of the prison sentence handed down.

If the court duly seised of an act classified as a misdemeanour by law, considers, at the end of the proceedings, that the act only constitutes a contravention, it shall impose the penalty and rule, if appropriate, on the civil action.

If the offence is a contravention related to a délit, the court shall rule in a single judgment, with a right of appeal against the whole.
