Subject to the exceptions provided for by regulation, the provisions of this chapter apply to defence or security contracts awarded by the State and its public establishments.
Defence or security contracts give rise to advance payments under the conditions laid down by regulation.

Defence or security contracts give rise to payments on account, under the conditions laid down by regulation, once the services have begun to be performed.The amount of a payment on account may not exceed the value of the services to which it relates.
All deferred payment is prohibited in defence or security contracts.However, a joint decision by the Minister for Defence and the Minister for the Budget may authorise the insertion of a clause providing for deferred payment to take account of special circumstances, such as urgency or the technical, functional or economic characteristics of an item of equipment or a service.
