Article L3662-6 of the French General Code of Local Authorities

The articles L. 3335-1 and L. 3335-2 apply to the Metropole of Lyon. In 2015, 2016 and 2017, for the application of Article L. 3335-2 to the Rhône department and the Metropole of Lyon, the transfer duties on immovable property collected by the Rhône department in 2012, 2013 and 2014 are allocated 19.2% to the Rhône department and 80.8% to the Metropole of Lyon.
The financial potential calculated in accordance with Article L. 3334-6 for both the Lyon metropolitan authority and the Rhône department takes into account the amount of the metropolitan compensation allowance defined in Article L. 3663-7. A decree in the Conseil d’Etat shall lay down the detailed rules for the application of this section.
The chapter VII of Title III of Book III of Part Two is applicable to the Metropole of Lyon.
Other than those provided for in article L. 3332-3, the revenues of the investment section of the Metropole of Lyon may include, where applicable, revenues from provisions under the conditions laid down by decree.
Any net increase in charges resulting from the transfer of responsibilities between the Rhône department and the Lyon metropolitan area in accordance with article L. 3641-2 is accompanied by the concomitant transfer to the Metropole of Lyon of the resources necessary for the normal exercise of these powers. On the date of the transfer, these resources ensure full compensation for the net costs transferred.
The costs corresponding to the exercise of transferred competences are subject to an evaluation prior to the transfer of said competences.
The local commission responsible for assessing the charges and resources transferred from the Rhône department, created by Article 38 of Law no. 2014-58 of 27 January 2014 on the modernisation of territorial public action and the affirmation of metropolises, is consulted on the terms and conditions for compensation for the charges corresponding to the powers transferred from the department. The amount of expenditure resulting from increases and decreases in charges is established for each competence transferred by a joint order of the ministers responsible for local authorities and the budget, after consulting the commission mentioned in Article L. 3663-3.
