PART THREE: THE DEPARTMENT

Members of the departmental council are entitled to training appropriate to their duties. The members of the departmental council benefit each year from an individual right to training recorded in euros, which may be accumulated over the entire term of office up to a ceiling and the annual amount of which is set for a period of three years. In addition to the leave of absence and credit for hours provided for in articles L. 3123-1 and L. 3123-2, members of the departmental council who are employees are entitled to training leave. Travel, subsistence and teaching expenses are eligible for reimbursement. Losses of income suffered by the elected member as a result of exercising his or her right to training under this section are compensated by the département up to a limit of eighteen days per elected member for the duration of the term of office and one and a half times the hourly value of the minimum growth wage per hour….

The provisions of articles L. 3123-10 to L. 3123-12 do not apply to study trips by departmental councils. The deliberations relating to these trips specify their purpose, which must be directly related to the interests of the department, as well as their estimated cost.

The provisions of this section only apply if the body providing the training has been approved by the Minister responsible for local and regional authorities under the conditions set out in article L. 1221-3.
