Book II: FORMATION AND EXECUTION OF CONTRACTS

Any breach of the information obligations set out in articles L. 221-5, L. 221-6, L. 221-8, L. 221-11, L. 221-12 to L. 221-14 is liable to an administrative fine of up to €15,000 for a natural person and €75,000 for a legal entity. This fine is imposed under the conditions set out in Chapter II of Title II of Book V.

Any failure to comply with the obligations to confirm the contract and, where applicable, the medium chosen by the consumer, as defined in Article L. 221-13, is liable to an administrative fine of up to 15,000 euros for a natural person and 75,000 euros for a legal person. This fine is imposed under the conditions set out in Chapter II of Title II of Book V.

Any failure to comply with the obligations set out in article L. 221-16 in relation to telephone canvassing and commercial prospecting is punishable by an administrative fine, the amount of which may not exceed €75,000 for a natural person and €375,000 for a legal entity. This fine is imposed under the conditions set out in Chapter II of Title II of Book V.

Any breach of the provisions of articles L. 221-18, L. 221-21 and L. 221-23 to L. 221-27 governing the conditions for exercising the consumer’s right of withdrawal and its effects, is punishable by an administrative fine of up to €15,000 for a natural person and up to €75,000 for a legal entity. This fine is imposed under the conditions set out in Chapter II of Title II of Book V.

Any breach of the provisions of article L. 221-17 relating to the ban on masked numbers in telephone canvassing is punishable by an administrative fine of up to €75,000 for a natural person and €375,000 for a legal entity. This fine is imposed under the conditions set out in Chapter II of Title II of Book V.

Where a fine is imposed pursuant to Articles L. 242-10 to L. 242-13, following a request for mutual assistance provided for in Article L. 511-10 relating to a large-scale or EU-wide infringement, pursuant to Article 21 of Regulation (EU) 2017/2394 of the European Parliament and of the Council of 12 December 2017 on cooperation between national authorities responsible for the enforcement of consumer protection laws, its amount may be increased…
