Failure by the employer to comply with the measures taken by the Regional Director of Companies, Competition, Consumption, Labour and Employment pursuant to Article L. 4721-1 is punishable by a fine of 3,750 euros.

Failure by the employer to comply with the measures taken by the inspection officer pursuant to articles L. 4731-1 or L. 4731-2 is punishable by one year’s imprisonment and a fine of 3,750 euros.

In the event of a breach of the provisions of article L. 4221-1, those of Book III as well as articles L. 4411-7, L. 4525-1 and L. 4721-4 and the decrees issued for their application, the judgment shall also set the time limit within which the safety and health work required by these provisions must be carried out. This period may not exceed ten months.

In the event of a conviction pursuant to article L. 4741-1, the court may order, as an additional penalty, that the judgment be posted at the doors of the convicted person’s establishments, at the latter’s expense, under the conditions set out inarticle 131-35 of the French Penal Code, and that it be published, in full or in excerpts, in the newspapers it designates. The provisions of articles L. 4741-1 to L. 4741-5 and L. 4741-9 to L. 4742-1 do not apply to the establishments mentioned in 2° and 3° of article L. 4111-1.

Employers are civilly liable for sentences handed down against their directors, managers or representatives.

Employing minors in habitual begging, either openly or under the guise of a profession, is punishable by the penalties set out in articles 225-12-6 and 227-29 of the Criminal Code.
