Validation of the entries of information and filings of documents provided for in Article L. 123-41, as well as the checks provided for in Article L. 123-42, are carried out by the registrar of the competent commercial court or judicial court ruling on commercial matters: 1° With regard to the register of commerce and companies, in application of articles R. 123-32, R. 123-35, R. 123-41, R. 123-43, R. 123-51, R….

The validation and checks mentioned in Article R. 123-270 are carried out within the same timeframes as those set for the register of companies, the special register of commercial agents or the special register of sole proprietorships with limited liability.

The clerk of the commercial court or of the judicial court ruling in commercial matters validates the following information and documents: 1° For natural persons, those mentioned in articles R. 123-243 to R. 123-245, in 1° and 3° of article R. 123-246 and in articles R. 123-247 to R. 123-251; 2° For legal entities, those mentioned in articles R. 123-252 to R. 123-258, 1°, 3° and 4° of article R….

The information and documents, for which validation of registration or filing in the National Register of Companies is provided for in Article L. 123-41, are sent to the clerk of the commercial court or of the judicial court ruling in commercial matters at the same time as the application for registration, amending registration, deletion or filing in the Trade and Companies Register, in the Special Register of Commercial Agents or…

The checks of the conditions necessary for access to and the exercise of his activity carried out by the registrar of the competent commercial court or court adjudicating in commercial matters are those provided for by the provisions relating to the register of commerce and companies, the special register of commercial agents or the special register of sole proprietorships with limited liability.

Refusal to register a legal entity in the Trade and Companies Register entails refusal to register it in the National Register of Companies. Refusal to register a natural person in the Trade and Companies Register or in the Special Register of Commercial Agents entails refusal to register in the National Register of Companies, unless the natural person has declared an activity that is not covered by one of these registers…
