Failure to comply with the provisions of the first to third paragraphs of article L. 7422-9 and article L. 7422-10 or the regulations adopted for their application is punishable by a fourth-class fine, imposed as many times as there are workers concerned.
Failure to comply with the first paragraph of article R. 7422-12 is punishable by a third-class fine.
The industrial tribunal hears disputes relating to the remuneration of home workers and, in particular, rectifies accounts showing rates lower than the minimum rate defined in articles L. 7422-4 and L. 7422-5. The difference between the salary actually paid and the salary that should have been paid is paid to the worker. No account shall be taken of any compensation that the employer may be ordered to pay.
In the event of a dispute concerning the remuneration of a worker carrying out work at home, the industrial tribunal shall publish, by posting on the door of the courtroom, the relevant rate resulting from the judgment. Any interested party and any professional association are authorised to take a copy of these rates, free of charge, from the clerk’s office of the industrial tribunal, and to publish them.
Any employer or agent who has work carried out in the home which presents risks covered by an order issued pursuant to article L. 7424-1, shall state the exact nature of the work in the declaration sent to the Labour Inspectorate.
The minimum period for complying with the formal notice provided for in article L. 7424-3 is set at fifteen days.
The procedures for applying the provisions of articles R. 7111-2 to R. 7111-35, relating to the professional identity card and the professional journalists’ identity card commission, are determined in Guadeloupe, Guyana, Martinique, Mayotte, La Réunion, Saint-Barthélemy and Saint-Martin by order of the State representative in the department or local authority.
For the application of article R. 7122-30 to Mayotte, the words: “and occupying one of the jobs defined by the agreement relating to the application of the unemployment insurance scheme to these professions provided for in article L. 5422-20” are replaced by the words: “and, where applicable, occupying one of the jobs defined by the agreement provided for in paragraph 2 of article L. 5524-2”.
