The local authority assumes responsibility for the harmful consequences resulting from accidents suffered by members of the territorial council in the course of their duties.

The local authority is subrogated to the rights of the victim to obtain from the perpetrators of the offences referred to in article LO 6325-9 the return of sums paid to the elected representative concerned.
