The Minister for the Economy and Finance may grant the local authority, in the event of a temporary shortfall in the latter’s cash position, advances chargeable to Treasury resources up to a maximum amount set each year by the Finance Act. A decree in the Council of State determines the conditions and limits under which these advances may be granted.
The Minister responsible for the economy and finance is authorised to grant advances to the local authority and the local authority’s public establishments that decide to take out a medium or long-term loan. Advances are repaid from the proceeds of the loan to be taken out and bear interest at the rate of that loan.
The President of the Territorial Council shall keep accounts of the commitment of expenditure under the conditions laid down by regulation.
The local authority’s accounting officer is solely responsible for carrying out, subject to the controls for which he is responsible, the collection of revenue and the payment of the local authority’s expenditure within the limits of the appropriations duly appropriated by the territorial council. .
The legislative provisions referred to in this Title are those in force on the date of promulgation of the loi organique n° 2007-223 du 21 février 2007 portant dispositions statutaires et institutionnelles relatives à l’outre-mer.
The new costs incurred by the local authority pursuant to the loi organique n° 2007-223 du 21 février 2007 portant dispositions statutaires et institutionnelles relatives à l’outre-mer shall be subject to the compensation provided for in the chapter IV of Title I of Book VI of Part One of the present code.
