Part Three: Combating disease and addiction

The opening of a 3rd or 4th category on-trade public house outside the conditions set out in this Title is punishable by a fine of 3,750 euros. The court will order the pub to be closed.

A fine of €3,750 shall be imposed for opening a café, cabaret or on-trade drinks outlet selling alcohol: 1° Without making the declaration provided for in article L. 3332-3 at least fifteen days in advance and in writing; 2° Without proving French nationality or that of another Member State of the European Union or another State party to the Agreement on the European Economic Area.

The offer or sale, in any form whatsoever, of drinks other than those in groups 1 and 3 as defined in article L. 3321-1, in pubs and cafés opened on the occasion of a public fair, sale or celebration and authorised by the municipal authority, is punishable by a fine of €3,750. Failure to comply with an establishment closure ordered or pronounced pursuant to articles L. 3332-15 or L. 3332-16 is punishable by two months’ imprisonment and a fine of 3,750 euros.

Setting up a takeaway in areas covered by the provisions of article L. 3335-2 is punishable by a fine of €3,750.

If an unemancipated minor or an adult under guardianship practices the profession of public housekeeper, the penalty is a fine of €3,750. In addition, the court may close the establishment for up to five years.

The following is punishable by a fine of €3,750: any person who is disqualified by one or more of the provisions of article L. 3336-2: 1° Operate a public house ; 2° Be employed in an establishment under the conditions set out in article L. 3336-3. In addition, the court orders the permanent closure of the establishment.

Repeated offences under articles L. 3352-3, L. 3352-4, L. 3352-8 and L. 3352-9 are punishable by six months’ imprisonment and a fine of €7,500. In the event of a repeat offence under article L. 3352-8, the court shall order the permanent closure of the establishment.
