PART FIVE: LOCAL COOPERATION

The provisions of Title III of Book I of Part Three relating to the control of legality and the publicity and entry into force of the acts of the departmental authorities are applicable to interdepartmental public establishments.

Any natural or legal person has the right to request communication of the deliberations and minutes of the deliberative assemblies of the public establishments of interdepartmental cooperation, budgets, accounts, as well as the decrees of the presidents of these public establishments. The provisions of the second paragraph of article L. 3313-1 apply to interdepartmental cooperation establishments. The places where the documents are made available to the public are the head office of the establishment and the hotels of the member departments.

When an interdepartmental institution or body mentioned in Article L. 5421-1 meets the conditions set out in Article L. 5721-2, it may be transformed into a mixed syndicate. This transformation is decided, on the proposal of the board of directors of the institution or body, by the concurring deliberations of its members. The department, municipalities and inter-municipal public establishments may create a public establishment between them called a departmental agency. This agency is responsible for providing technical, legal or financial assistance to local authorities and inter-municipal public establishments in the department that request it.

Two or more regions may, for the exercise of their competences, conclude agreements with each other or create institutions of common utility.
