According to the conditions set out in an annual resolution, the deliberative body of the public establishment for inter-communal cooperation may make a vehicle available to its members or to the public establishment’s employees when this is justified by the performance of their mandates or duties. Any other benefit in kind is subject to a resolution specifying the name of the vehicle and the terms and conditions of use.

The articles L. 2123-18, L. 2123-25-1 to L. 2123-27, the first and second paragraphs of article L. 2123-28 and article L. 2123-29 apply to members of the deliberative bodies of the public establishments for inter-municipal cooperation mentioned in articles L. 5211-12 and L. 5215-1.

Establissements publics de coopération intercommunale are liable, under the conditions set out in articles L. 2123-31 to L. 2123-33 for municipal councillors and mayors, accidents to members of their deliberative bodies and their chairmen in the performance of their duties. The provisions of article L. 2123-34 relating to the responsibility of elected representatives are applicable to the president and vice-presidents who have received a delegation.
