The doctor or doctors who sign the death certificate keep a copy. One copy is given to the director of the health establishment in which the death certificate was drawn up. The original is kept in the deceased’s medical file.
Organs may only be removed from a deceased person if that person is assisted by mechanical ventilation and retains haemodynamic function. However, organs from a list established by order of the Minister of Health, made on the recommendation of the Biomedicine Agency, may be removed from a deceased person with persistent cardiac and respiratory arrest.
The samples referred to in the second paragraph of Article R. 1232-4-1 are taken in accordance with protocols issued by the Agence de la biomédecine. These protocols determine in particular the situations in which these samples may be taken and the conditions under which they are taken.
The medical measures taken prior to removal to ensure the preservation of the organs of a person whose death has been duly confirmed shall be discontinued if it appears that this person had expressed opposition to organ donation during his or her lifetime under the conditions laid down in Section 2 of this Chapter.

Refusal of removal may concern all the organs and tissues likely to be removed or only some of these organs or tissues.
Refusal of organ removal may be reviewed and revoked at any time. The hospital organ procurement coordination team takes into account the most recent expression of wish.
The procedures for expressing refusal as defined in article R. 1232-4-4 are the subject of public information provided by the Agence de la biomédecine.
The automated national register instituted by Article L. 1232-1 shall be operated and managed by the Agence de la biomédecine under the conditions laid down in this section.
Any person of full age or a minor of at least thirteen years of age may be entered on the register in order to make known their refusal to have organs removed from their body after their death, either for therapeutic purposes, or to investigate the cause of death, or for other scientific purposes, or in more than one of these three cases.
