If the National Council uses the tender procedure, it cannot negotiate with the tenderers. It may only ask them to specify the content of their tender. Where the national council uses the procedure with negotiation, it may award the contract on the basis of the initial tenders without negotiation, provided that it has indicated in the contract notice that it reserves the right to do so.
