Reasons are given for refusal of authorisation, in compliance with the rules set out in article L. 1110-4 of the Public Health Code. The applicant and, where applicable, the person(s) exercising parental authority or the legal representative of the person concerned, are notified of the refusal in a sealed envelope, together with the reasoned unfavourable opinion of the committee of experts provided for in article L. 232-2.

All the medical examinations and documents required to examine the authorisation application are at the applicant’s expense. The applicant pays a flat-rate contribution to the costs of this investigation, according to a tariff set by the agency.

The Therapeutic Use Exemption does not replace the certificate attesting to the absence of contraindication to participation in sporting competitions issued pursuant to article L. 231-2-1. It does not replace a doctor’s prescription for the substance or method whose use it authorises.

Decisions granting Therapeutic Use Exemptions are forwarded by the French Anti-Doping Agency to the World Anti-Doping Agency as well as to the International Federation concerned and, where applicable, to the foreign National Anti-Doping Organisation concerned, within twenty-one days of their notification. When the French Anti-Doping Agency decides to reject or grant an application for recognition of a Therapeutic Use Exemption issued by an International Federation or a body referred to in 4° of article L. 230-2, it shall inform the issuing authority and the World Anti-Doping Agency within twenty-one days.
