Part Five: Employment

Unemployed workers who have exhausted their entitlement to insurance benefit, who do not qualify for the self-employed workers’ benefit provided for in article L. 5424-25 and who satisfy the conditions of previous activity and resources are entitled to a specific solidarity allowance.

Beneficiaries of the insurance allowance who are at least fifty years old and who meet the conditions set out in article L. 5423-1 and who opt to receive this allowance are also entitled to the specific solidarity allowance. In this case, payment of the insurance allowance is suspended.

Self-employed artists who do not qualify for the insurance allowance are also entitled to the specific solidarity allowance, subject to age and previous activity.

Subject to the provisions of Articles L. 5426-8-1 to L. 5426-8-3, the specific solidarity allowance may not be transferred or seized. The blocking of current deposit or advance accounts may not have the effect of preventing its unseizability. Notwithstanding any opposition, beneficiaries whose allowance is paid into a current deposit or advance account may make monthly withdrawals from this account up to the amount of their allowance.

The rate of the specific solidarity allowance is revalued on 1st April each year by applying the coefficient mentioned in article L. 161-25 of the Social Security Code and is set by decree.

The specific solidarity allowance cannot be combined with the disabled adult allowance mentioned in articles L. 821-1 and L. 821-2 of the social security code once a payment has been made in respect of the latter allowance and as long as the conditions of eligibility for the latter remain fulfilled.
