The legal entities referred to in article L. 5134-101 that request the benefit of an agreement entitling them to contracts relating to the activities of “adultes-relais” shall submit their request to the Prefect.

The projects selected are the subject of an agreement for each position signed between the employer and the State, represented by the Prefect, and in the presence of the National Agency for Social Cohesion and Equal Opportunities, represented by its departmental delegate.
The term for which the agreement is signed may not exceed three years. The agreement may be renewed by express agreement of the parties.

No recruitment may take place before the date on which the agreement is signed.
The Prefect monitors the performance of the agreement. To this end, the employer shall provide the Prefect, at the latter’s request, with any information needed to verify the proper implementation of the agreement and the reality of the jobs created.
The agreement may be terminated by the Prefect, particularly if the employer fails to comply with the terms of the agreement. The Prefect, in his capacity as the Agency’s delegate, may demand repayment of sums unduly received. The employment contract is concluded with a person who, on the date of signature, fulfils the conditions of article L. 5134-102.
Where an employment contract is concluded on a part-time basis, it may not be less than half-time.
