The organisations responsible for carrying out all or part of the actions referred to in article L. 6313-1 shall submit all documents and records establishing the objectives and implementation of these actions as well as the resources used for this purpose. If they fail to do so, the actions are deemed not to have been carried out and the co-contractor will be reimbursed any sums unduly received.

The organisations mentioned in a to d of 1° of article L. 6361-2 pay the Treasury a sum equal to the amount of unjustified use of funds that has been rejected in application of article L. 6362-10.

Expenditure incurred by the bodies mentioned in 2° of article L. 6361-2 which does not comply with their purpose or the stipulations of the agreements entered into with the State shall give rise to repayment to the State, in proportion to its financial contribution, under the conditions laid down by the texts governing these agreements or the stipulations of the latter.

The organisations responsible for carrying out all or part of the actions mentioned in article L. 6313-1 shall pay to the Treasury, jointly and severally with their de facto or de jure managers, a sum equal to the amount of expenditure that has been the subject of a rejection decision pursuant to article L. 6362-10.

In the event of an inspection, the reimbursements referred to in articles L. 6362-4 and L. 6362-6 are made within the period set for the interested party to submit his observations. Failing this, the interested party shall pay to the Treasury, by decision of the administrative authority, a sum equivalent to the reimbursements not made.

Any employer or body responsible for carrying out all or part of the actions referred to in Article L. 6313-1 which intentionally draws up or uses documents likely to obtain improper payment of aid, payment or assumption of responsibility for all or part of the cost of vocational training services shall be required, by decision of the administrative authority, jointly and severally with its de facto or de jure managers,…

Without prejudice to the provisions of articles L. 8114-1 and L. 8114-2, refusal to submit to the checks provided for in this chapter shall give rise to automatic assessment by the administration of the sums subject to the reimbursements or payments to the Treasury provided for in this book. A decree of the Conseil d’Etat shall determine the terms and conditions for the application of this article.
