The minimum growth wage applicable to young workers under the age of eighteen is reduced by : 1° 20% Before the age of seventeen; 2° 10% Between the ages of seventeen and eighteen. This reduction is waived for young workers with six months’ professional experience in the branch of activity to which they belong.
When the minimum growth wage is increased in application of the provisions of article L. 3231-5, a joint order of the ministers responsible for labour, agriculture and the economy and finance announces the new amount of this wage.
Employees defined in Article L. 3231-1 who have reached the age of eighteen receive from their employers, when their contractual hourly wage has fallen below the minimum growth wage in force, a supplement calculated so as to bring their remuneration up to the amount of this minimum growth wage.
The hourly wage to be taken into consideration for the application of article D. 3231-5 is that which corresponds to one hour’s actual work, taking into account benefits in kind and various bonuses which have the effect of additional pay. Sums paid by way of reimbursement of expenses, statutory overtime allowances and transport bonuses are excluded.
The rate of the minimum growth wage determined in application of article L. 3231-6 is set following the following procedure: 1° The National Commission for Collective Bargaining, Employment and Vocational Training receives from the Government, in good time, an analysis of the nation’s economic accounts and a report on general economic conditions ; 2° The Commission deliberates on these elements and, taking into account the changes that have already occurred…
The provisions of this sub-section do not apply to employees in agricultural occupations, merchant navy seagoing personnel, caretakers and employees of residential buildings and domestic servants when part of their remuneration usually consists of the provision of food and accommodation.
Where part of an employee’s remuneration usually consists of the provision of food and accommodation or other benefits in kind, the guaranteed minimum cash wage is determined by deducting from the minimum growth wage the sums set to assess the benefit in kind.
When the employer provides food, in whole or in part, this benefit in kind is valued by collective labour agreement. Failing this, food is valued per day at twice the guaranteed minimum or, for a single meal, at once this minimum.
For employees for whom the employer provides accommodation, this benefit in kind is valued by agreement or collective labour agreement.Failing this, accommodation is valued at 0.02 euros per day.
Benefits in kind, other than food or accommodation, are valued at their actual value, at cost to the employer.
