Title II: Medicinal products for human use

In the event of absence or impediment of the pharmacists in charge or delegates, their replacement may not exceed one year, except in the case of military obligations. In this case, the replacement period is extended until the impediment ceases. In the event of the permanent cessation of the duties of the pharmacist in charge, a new pharmacist in charge is appointed without delay.

The pharmacist in charge and the interim pharmacist(s) in charge of the Agence nationale de santé publique are appointed by the Director General of this establishment.

In non-profit and humanitarian organisations, the interim pharmacist(s) in charge is/are appointed by the president of the association.

Where the company is owned by a pharmacist, the pharmacist may be replaced by : 1° A delegated or assistant pharmacist from the same company ; 2° A pharmacist who has no other professional activity during the period of his replacement and who is registered for this purpose with the competent section of the Ordre national des pharmaciens.

In the central army pharmacy and in the army health service medical supply establishments, the interim pharmacist(s) in charge are appointed by the Minister of Defence.

In pharmaceutical establishments created within public establishments and non-profit organisations in application of article L. 5124-9-1, the legal representative of the legal entity concerned appoints, at the same time as the pharmacist in charge, one or more interim pharmacists in charge. Pharmacists replacing or managing a pharmacy after death must provide proof of the practical experience provided for, as appropriate, in articles R. 5124-16 to R. 5124-18. Pharmacists providing a replacement for a managing or delegated pharmacist must devote themselves exclusively to this activity during the period for which they are responsible.
