Title V: Medical and pharmaceutical staff

For any procedure or consultation, a patient who chooses to be treated as a self-employed practitioner is given, in advance, full details of the rules that will apply to him as a result of his choice. In the event of hospitalisation, they must expressly state in writing their choice to be treated as a private practitioner. The provisions of article R. 1112-23 are applicable in all public health establishments.

The proportion of the technical package mentioned in the last paragraph of Article L. 6154-3 is set at 20% of its amount.

Practitioner hospital radiologists who perform scanography procedures provide the director of the public health establishment with a quarterly summary statement of the number of scanography procedures performed as part of their private practice.

The public health establishment pays hospital radiologists the share of the technical fee mentioned in article R. 6154-8 on a quarterly basis.

The fee referred to in Article L. 6154-3, payable to the establishment by self-employed practitioners, is set as a percentage of the fees they receive for this activity. However, fees received for examinations for which the fee structure separates the intellectual service from the operating costs of the equipment are not subject to the fee.

The summary statement referred to in the first paragraph of Article R. 6154-3 gives details of the procedures performed as part of the self-employed activity, in code and value.

The rate of the fee referred to in Article L. 6154-3 is set as follows: 1° Consultations: 16% for university hospital centres, 15% for hospital centres ; 2° Procedures other than imaging, radiotherapy, nuclear medicine and biology procedures: 25% for university hospital centres, 16% for hospital centres; 3° Imaging, radiotherapy, nuclear medicine and biology procedures: 60% for university hospital centres and for hospital centres.
