The medical file is established following the examinations and visits provided for in article R. 4426-7. When biological agents are likely to cause illnesses with a long incubation period, the medical record is kept for a period of up to forty years after known exposure has ceased.
When the company disappears or when the worker changes company, the medical file is sent either to the occupational physician of the new company, or to the occupational health inspector, who is responsible for sending it, where appropriate, at the worker’s request, to the occupational physician now responsible. At the worker’s request, the medical file is sent to the doctor designated by the worker.
Workers are given information and advice on the individual monitoring of their state of health, which they should be able to take advantage of once exposure has ended.
The occupational physician is informed by the employer of the deaths and absences due to illness of workers exposed to pathogenic biological agents, when these absences exceed the durations set by joint order of the ministers responsible for labour, health and agriculture according to the nature of the activities carried out and the conditions of exposure to the biological agents.
If a worker is found to be suffering from an infection or disease listed in an occupational disease table and which may be the result of exposure to biological agents, all workers likely to have been exposed at the same workplace will undergo a medical examination, possibly accompanied by additional tests. The first use of biological pathogens must be declared to the Labour Inspectorate at least thirty days before the work begins.

A declaration of first use is also sent to the labour inspection officer, at least thirty days before their first use, for biological agents not yet classified within the meaning of article R. 4421-4, where there is a presumption that they are pathogenic.
The declaration of first use is not compulsory for laboratories carrying out medical biology analyses. They are only required to declare their intention to provide a diagnostic service for group 4 biological agents.
The declaration of first use is renewed whenever a significant change in processes or procedures renders it obsolete.
